Wastewater charges
Water suppliers may charge for wastewater in different ways, including fixed charges or charges for the amount of wastewater produced. This varies around the country.

Landlords are usually responsible for fixed wastewater charges. These are charged whether or not the property is occupied.

Tenants may be charged for the wastewater they produce. Some water suppliers calculate wastewater based on how much water they supply.

    usually 는 일반적, 아님 보통 이라는 말로 반드시 landloard가 내지 않아도 된다는 뜻이 아닌가요?
tenancy service에서 규정하는 이 문구로 landlord가 내야 된다는 것은 반드시 아닐수 있어서요...

Fixed charge 는 주인이냄니다. 걱정마시고 요구하세요.
Usually 주인이 내는건데 계약시 특별 조항이 없었다면 보편적인 법을 따르는거지요. 제 주인도 몰랐는데 agency가 중간에서 얘기해서 해결했습니다. 대부분의 주인들도 인지하고 있습니다.

일단 fixed charges는 집주인의 납세의무사항입니다.  unless The tenant is responsible to pay for the water and wastewater charges only
The property has a separate water meter
The water supplier provides water to the property on a metered basis, or
The charges can be exclusively attributed to the tenants in occupation of the premises.  그리고 집주인과 계약시 계약서에 명시하셨다면 tenant가 내셔야합니다.

계약서에 fixed charge를 tenant가 내야한다 명시되어있더라도 Residential Tenancy Act가 agreement 계약서를 over rule 하기때문에 fixed charge는 landlord의 책임이 됩니다.

또 다른 예로, 계약서에 end of tenancy에 commercial carpet cleaning을 tenant가 해야 한다는 조항도 있을때도 있는데 이것도 역시 Residential Tenancy Act 에 따라서 over rule 되고 tenant는 reasonably clean and tidy condition으로 청소를 하면됩니다.

25New section 39 substituted
Section 39 is repealed and the following section substituted:

“39Responsibility for outgoings
“(1)The landlord is responsible for all outgoings in respect of the premises that—

“(a)are incurred whether or not the premises are occupied; and

“(b)are incurred for common facilities.

“(2)Without limiting the generality of subsection (1), the landlord is responsible for the cost of—

“(a)the general rate (within the meaning of section 13 of the Local Government (Rating) Act 2002) payable in respect of the premises; and

“(b)insurance premiums payable in respect of the premises; and

“(c)any body corporate levies payable in respect of the premises.

“(3)The tenant is responsible for all outgoings in respect of the premises that are exclusively attributable to the tenant’s occupation of the premises or to the tenant’s use of the facilities.

“(4)Without limiting the generality of subsection (3), the tenant is responsible for the following charges, incurred during the tenancy, in respect of the premises:

“(a)electricity and gas:

“(b)telephone and Internet:

“(c)supply of water if the water supplier charges for water provided to the premises on the basis of consumption.

“(5)In this section, premises includes facilities that are exclusively for the use of the tenant.”
