This is an issue that pops up all the time on here and once for all I would like to get to the bottom of it.
I believe there are 2 issues, one is building something, and one is renting the said area.
1. Building: You can build anything you want ilegally, but lets stick with legal stuff. So you get permit and you build or put in what you are allowed to do. Which may not be an oven or full kitchen, but its got toilet and shower, and running water and a sink, and maybe a little bench. And basically provides all that you basically need to live in. So its effectively a mini studio, a perfectly liveable area.
2. Renting it out.
Can you do this under the tenancy act, its not a legal flat is it, it may be a rumpus, it may be a nice garage, it may be part of the house.
Are there laws on what you must provide for a tenant ?
Are you breaking laws by renting this out ???
Does the council have a problem - a lawful problem - with you renting out something that has full building consent.
If the tenancy laws have a problem with this, can you then "lease" it out as a business arrangement, you are not covered by the potentially onerous tenancy act.
And the people who lease it, do what ever they want with it, sleep in, business, whatever, you dont care.
Or does the tenancy tribunal / council, have power to stop that kind of activity - maybe ???
